Terms of Sale

These terms apply to every purchase made through terraficta.com. Please read them before ordering. If anything is unclear, write to us at atelier@terraficta.com before you buy.

Who we are

Terra Ficta is a trading name of [Marvin Koppejan Holding B.V. — please confirm exact legal spelling], registered in the Netherlands under Chamber of Commerce (KVK) number 54900816, VAT number NL81484323B01 — please double-check, see note below, with its registered address at [address, Amsterdam]. We are referred to as "we", "us", or "Terra Ficta" in these terms. The person or organisation placing an order is referred to as "you".

The works and editions

Every work sold through Terra Ficta is issued as a numbered, limited edition, printed to the size stated at the time of purchase. Edition sizes are shown on each work's page. Once an edition is fully sold, or a specific size is withdrawn, that size can no longer be ordered, and this is noted on the site as "Edition closed".

Colours on screen are a close approximation of the printed work but can vary depending on your display. Prints are giclée on matte museum paper unless stated otherwise.

Prices and payment

All prices are shown in euros and include VAT where applicable. Prices exclude shipping, which is calculated and shown before you complete your order. We reserve the right to change prices for works not yet ordered; the price you pay is the price shown at the moment your order is placed and confirmed.

Payment is processed securely through Stripe. We do not store your card details. Your order is confirmed once payment has been successfully collected.

Order and contract

A contract of sale is formed when we confirm your order by email after successful payment. We may decline or cancel an order — for example if a size has sold out between browsing and payment — in which case you will be refunded in full within a reasonable time.

Shipping and delivery

Each work is printed to order and shipped in a rigid tube, tracked. Estimated timelines: Netherlands and the rest of the EU 2–7 working days after printing; UK and US 5–7 working days; the rest of the world may take longer. These are estimates, not guarantees, and printing itself typically adds a few days before dispatch.

Risk of loss or damage in transit passes to you once the package is delivered to the address you provided. If a work arrives damaged, see Section 8.

You are responsible for providing an accurate delivery address. Import duties or taxes for shipments outside the EU are your responsibility and are not included in the price.

Right of withdrawal (EU and UK customers)

If you are a consumer ordering from within the EU or UK, you generally have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason, in line with EU consumer protection law.

To withdraw, email atelier@terraficta.com within the 14-day period stating your order details. You must then return the work, unused and in its original packaging where possible, within 14 days of that notice. Return shipping costs are your responsibility unless the work was faulty or incorrectly described. We will refund the purchase price, including the original delivery cost, within 14 days of receiving the return, using the same payment method you used to pay.

Because each print is produced to order in a numbered edition, this right may not apply in the same way it does to stocked goods. [This section should be confirmed with a legal adviser before publishing — in particular, whether Terra Ficta's editions qualify for the "custom-made goods" exception under Dutch law (Art. 6:230p BW), and if so, this section should be revised to state that clearly instead of offering full withdrawal rights.]

Conformity and complaints

We take care that every print matches its description and leaves the studio in good condition. If a work arrives damaged, or does not match what you ordered, contact us within 14 days of delivery with photos of the issue. We will arrange a replacement print or a full refund, including return shipping, at your choice.

Outside of this, statutory consumer guarantees under Dutch and EU law continue to apply.

Intellectual property

Purchasing a print transfers ownership of that physical object only. It does not transfer copyright, and does not grant you the right to reproduce, scan, photograph for commercial use, or create derivative works from the image. All imagery, titles, and the Terra Ficta name remain the property of [Holding B.V.].

Liability

Our liability for any claim arising from your order is limited to the price you paid for the relevant work. We are not liable for indirect or consequential loss. Nothing in these terms limits liability where it cannot lawfully be limited, including liability for death, personal injury, or fraud.

Complaints and disputes

If something is not right, please contact us first at atelier@terraficta.com — most things are resolved faster by email than by any other route. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Governing law

These terms are governed by the laws of the Netherlands. Where you are a consumer resident elsewhere in the EU, you retain the protection of any mandatory consumer-protection provisions of your own country's law that cannot be excluded by agreement.
